Pre- and Post-Nuptial Agreements
Sometimes, before or after marriage, an individual wants to protect his or her assets and income from the claims of a future or current spouse. Under these circumstances, a pre- or post-nuptial agreement may be appropriate. When representing the party who is attempting to safeguard assets and income, I make recommendations and negotiate an agreement which attempts to protect my client to the greatest extent possible, while being mindful of the necessity of treating the other party fairly. When representing the party who is being asked to sign such an agreement, I explain his or her rights and obligations under the proposed agreement as well as the rights and obligations that would exist if the agreement were not signed. I then try to negotiate the best possible agreement for my client with the goal of obtaining as much financial security as possible.
